C.S.H.B. 2442 78(R) BILL ANALYSIS C.S.H.B. 2442 By: Flores Licensing & Administrative Procedures Committee Report (Substituted) BACKGROUND AND PURPOSE Current law stipulates that no more than 40 percent of the individuals attending a bingo occasion may use electronic or mechanical card minding devices. The percentage was agreed to by industry representatives at the time the devices were new and being proposed for use during bingo occasions. Industry representatives and regulators alike, now agree that the use of the devices should be extended. CSHB 2442 removes the limitation on the use of card minding devices to allow an unlimited number of persons to use them at a bingo occasions. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Repeals Section 2001.409 (b) of the Occupations Code to delete the provision that no more than 40 percent of the individuals attending a bingo occasion may use electronic or mechanical card minding devices. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect on September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE CSHB 2442 modifies the originals by repealing Section 2001.409(b) in standard repealer language rather than printing the section and drawing a line through section (b). CSHB 2442 is a Legislative Council clean-up including changing the effective date to 2003 from 2001 in the original.
