C.S.H.B. 2455 78(R) BILL ANALYSIS C.S.H.B. 2455 By: Chisum State Affairs Committee Report (Substituted) BACKGROUND AND PURPOSE This bill is the Sunset schedule bill, which may also serve as a possible safety net in the event an agency sunset bill is in danger of not passing. The bill provides for changes to the review schedule, which periodically needs adjustment to balance the workload of the Sunset Advisory Commission. The Commission's schedule now has 47 reviews for the next review cycle. RULEMAKING AUTHORITY It is the opinion of the committee that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 2455 updates standard Sunset language changing the date of abolishing the following entities: _Prescribed Burning Board - from 2009 to 2007 _Texas Online Division of the Department of Information Resources - from 2005 to 2009 _Electronic Government Program Management Office of the Department of Information Resources from 2005 to 2009. _Onsite Wastewater Treatment Research Council - from 2005 to 2013 C.S.H.B. 2455 removes the following entities from specific Sunset review: _Texas Food and Health Advisory Council _Dental Hygiene Advisory Committee _Texas Environmental Education Partnership Fund The bill also provides that the working papers of the Sunset Advisory Commission are not subject to public disclosure and specifies certain records that fall under the working paper exception. EFFECTIVE DATE September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 2455 adds language which removes the Texas Environmental Education Partnership Fund from specific Sunset review. The substitute modifies language in the original providing that working papers of the Sunset Advisory Commission are not subject to public disclosure.
