H.B. 2475 78(R) BILL ANALYSIS H.B. 2475 By: Callegari Land & Resource Management Committee Report (Unamended) BACKGROUND AND PURPOSE Under the provisions of a strategic partnership agreement, a municipality and a utility district may authorize the limited annexation of portions of the district. Currently, many utility districts are made up of non-contiguous tracts of land that are separated by the right of way of a roadway or drainage course that existed before the district's creation. In such cases, a limited purpose annexation performed in connection with a strategic partnership agreement may include portions of publiclyowned land (i.e. right of way) in order to establish contiguity. Under current law, a municipality must treat publicly-owned land in the same way that it would treat privately-owned land, and annex it for general purposes within three years. H.B. 2475 exempts state, federal, or local property located within a utility district participating in a strategic partnership agreement from the requirement that the municipality annex the property for general purposes within three years. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Amends Section 43.123, Local Government Code, as follows: Exempts federal, state and local property located outside of a water control and improvement district or a municipal utility district that has been annexed for limited purposes in connection with a strategic partnership agreement from the three year deadline for a municipality to annex the area within the district for general purposes. SECTION 2. Amends Subsection 43.127(a), Local Government Code, to make conforming changes. SECTION 3. Effective date. Act retroactive. EFFECTIVE DATE September 1, 2003
