SRC-AMY H.B. 2525 78(R) BILL ANALYSIS Senate Research CenterH.B. 2525 By: Ellis, Dan (Whitmire) Criminal Justice 5-23-2003 Committee Report (Amended) DIGEST AND PURPOSE Section 22.01(b) of the Penal Code makes it a third degree felony to commit an offense against a public servant. Currently, Texas contracts with several private companies to carry out the typical duties of public servants. H.B. 2525 includes in this assault provision persons who are under contract with the government to perform a service or certain employees of that person. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 22.01(b), Penal Code, to include in the third degree offense provision those persons who are under contract with the government to perform a service or certain employees of that person. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2003. LIST OF COMMITTEE AMENDMENTS Committee amendment No. 1: On page 1, line 20, after the word "service" insert "in a facility as defined by Section 1.07(a)(14), Penal Code; Section 51.02(13), Family Code; or Section 51.02(14), Family Code."
