SRC-LBB H.B. 2543 78(R) BILL ANALYSIS Senate Research Center H.B. 2543 78R8222 EMT-DBy: Bonnen (Jackson) State Affairs 5/16/2003 Engrossed DIGEST AND PURPOSE Under the Charitable Raffle Enabling Act, non-profit corporations are allowed to have raffles; however, the prize must be a non-cash prize. These organizations frequently engage in projects to raise money that is used for the good of the public. H.B. 2543 sets the maximum value, as it relates to prize money, including cash, a check, and other cash equivalents, at $250. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 2002.056(a) and (b), Occupations Code, as follows: (a) Prohibits the total amount of prizes consisting of money, including cash, a check, and other cash equivalents, offered or awarded at a raffle from exceeding $250. (b) Prohibits the value of a prize, other than money, offered or awarded at a raffle that is purchased by the organization or for which the organization provides any consideration from exceeding $50,000. SECTION 2. Effective date: upon passage or September 1, 2003.
