C.S.H.B. 2691 78(R) BILL ANALYSIS C.S.H.B. 2691 By: Keffer, Jim Transportation Committee Report (Substituted) BACKGROUND AND PURPOSE Some all-terrain vehicles (ATVs) are now designed to carry passengers. CSHB 2691 would amend the Transportation Code to include passenger-carrying ATVs in the definition of an "all-terrain vehicle." The bill would also legalize the carrying of passengers on ATVs if the ATV was designed to do so. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Amends Section 663.001(1), Transportation Code, to include passenger ATVs in the definition of an "all-terrain vehicle." SECTION 2. Amends Section 663.036, Transportation Code, to delete the prohibition on carrying a passenger on an ATV designed to carry passengers. EFFECTIVE DATE September 1, 2003 COMPARISON OF ORIGINAL TO SUBSTITUTE The Committee Substitute for HB 2691 differs from the original in that it is a Legislative Council draft.
