C.S.H.B. 2738 78(R) BILL ANALYSIS C.S.H.B. 2738 By: Taylor County Affairs Committee Report (Substituted) BACKGROUND AND PURPOSE Currently, under Section 240.002 of the Local Government Code, the commissioners court of a county may prohibit or regulate the keeping of wild animals. This bill would clarify that the commissioners court may delegate the authority to public health districts. It is not limiting to regulation by only public health districts, it is only clarifying an implication from the original intent. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Section 1:Authorizes commissioners court to delegate the authority to regulate dangerous wild animals to public health districts. Section 2: Clarifies current statue in regards to a public health district and regulation procedures of dangerous wild animals. Section 3: Effective date EFFECTIVE DATE Immediate effect if two-thirds of each full house votes in favor, if not the September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE Strikes Section 2 of the original bill because the language not needed as counties may delegate regulation of wild animals through the language in Section 1 of the bill.
