C.S.H.B. 2799 78(R) BILL ANALYSIS C.S.H.B. 2799 By: Thompson Judicial Affairs Committee Report (Substituted) BACKGROUND AND PURPOSE There is some uncertainty regarding the applicability of the Uniform Municipal Courts of Record Act (the "Act") to all municipalities which create municipal courts of record. C.S.H.B. 2799 resolves this uncertainty by specifying that the Act applies to all municipalities which create municipal courts of record pursuant to Section 30.00003 of the Government Code. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 2799 amends the Government Code to provide that the Uniform Municipal Courts of Record Act applies to all municipalities which create municipal courts of record pursuant to Section 30.00003 of the Government Code. EFFECTIVE DATE September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute is a Legislative Council draft, whereas the original is not. There are no substantive changes.
