SRC-AMY H.B. 2859 78(R) BILL ANALYSIS Senate Research Center H.B. 2859 By: Wohlgemuth (Ogden) Infrastructure Development and Security 5/5/2003 Engrossed DIGEST AND PURPOSE Currently, the Texas Aeronautics Commission's (TAC) permitting process for towers more than 200 feet high has never been implemented or funded and TAC has been integrated into the Texas Department of Transportation (TxDOT) since establishing the process. Through exemption of structures regulated by the Federal Communication Commission or the Federal Aviation Administration, few towers are subject to the permitting process. H.B. 2859 repeals TxDOT's authority to regulate the height of towers as potential obstacles to air navigation. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Chapter 25 (Obstruction to Air Navigation Control), Transportation Code. SECTION 2. Effective date: upon passage or September 1, 2003.
