SRC-AMY H.B. 2889 78(R) BILL ANALYSIS Senate Research Center H.B. 2889 78R4043 SMJ-DBy: Cook, Robby (Armbrister) Intergovernmental Relations 5/16/2003 Engrossed DIGEST AND PURPOSE Subchapter C, Chapter 1508 (Obligations for Municipal Parks, Recreational Facilities, and Airports), Government Code, was originally enacted in 1935 and made applicable at that time to cities with a population of 230,000 or more. The legislation authorized the issuance of "revenue bonds, notes and warrants" for parks and other recreational facilities. H.B. 2889 lowers the applicability of the subchapter from a municipality with a population of 230,000 or more, to a municipality with a population of 5,000 or more. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 1508.101, Government Code, to provide that the subchapter applies only to a municipality with a population of 5,000 or more, rather than 230,000 or more. SECTION 2. Amends the heading to Subchapter C, Chapter 1508, Government Code, to read as follows: SUBCHAPTER C. OBLIGATIONS FOR HEALTH AND RECREATIONAL FACILITIES IN MUNICIPALITIES WITH POPULATION OF 5,000 OR MORE SECTION 3. Effective date: upon passage or September 1, 2003.
