SRC-VRA H.B. 2924 78(R) BILL ANALYSIS Senate Research Center H.B. 2924 78R6904 DRH-DBy: Geren (Brimer) Intergovernmental Relations 5/17/2003 Engrossed DIGEST AND PURPOSE Currently, municipalities and counties are authorized, after several procedural requirements are satisfied, to establish Public Improvement Districts (PID). The law authorizes the creation and dissolution of a PID, but does not expressly authorize amending the boundaries. While the requirements are designed to keep the public informed and involved in the process, they may be considered excessive, especially when the proposed changes are non-controversial or unchallenged. H.B. 2924 allows the expansion of PIDs and creates a more streamlined method for proposed expansions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter A, Chapter 372, Local Government Code, by adding Section 372.0125, as follows: Sec. 372.0125. ADDITION OF TERRITORY. (a) Authorizes a municipality to add territory in the municipality or the extraterritorial jurisdiction of the municipality to a public improvement district created by the municipality only if requested by a petition signed by certain individuals. (b) Authorizes a county to add territory in the county to a public improvement district created by the county only if requested by a petition signed by certain individuals. SECTION 2. Effective date: upon passage or September 1, 2003.
