BACKGROUND AND PURPOSE 
Under current law, a director or employee of a Sports and Community Venue
Districts governed by Chapter 335 of the Local Government Code shall
disclose a vendor relationship in a written conflicts disclosure statement
filed with the board secretary.  Committee Substitute House Bill 3021
would require the disclosure of financial or business relationships by a
director, the mayor or county judge who appointed the board, and each
member of the governing body of the municipality or county that created
the district. Disclosure would be made in the board's minutes and to the
Texas Ethics Commission, and would preclude a director from voting or
participating in any action related to the disclosure. Failure to make the
requisite disclosure would be a third degree felony. 


RULEMAKING AUTHORITY
This bill does not expressly delegate any additional rulemaking authority
to a state officer, department, agency, or institution.  


SECTION BY SECTION ANALYSIS
SECTION 1.Amends Subchapter F, Chapter 335, Local Government Code, by
adding Section 335.1085, which requires a director, the mayor or county
judge who appointed the board, and each member of the governing body of
the municipality or county that created the district to disclose any
financial or other business relationship with any person doing business
with the district. The disclosure shall be in the board's minutes and to
the Texas Ethics Commission.  A disclosure precludes a person's
participation or vote on any action related to the person about whom the
disclosure was made. Failure to disclose any such financial or other
business relationship is a third degree felony.    

SECTION 2.This Act only applies to any action taken, or disclosure
required, on or after November 1, 2003. 

SECTION 3.  Effective date.

EFFECTIVE DATE: September 1, 2003.


COMPARISON OF ORIGINAL TO SUBSITUTE
C.S.H.B. 3021 extends the disclosure requirements of the original to the
mayor or county judge who appointed the board, and each member of the
governing body of the municipality or county that created the district.
