SRC-AMY H.B. 3023 78(R) BILL ANALYSIS Senate Research Center H.B. 3023 78R9526 DLF-FBy: Taylor (Williams) State Affairs 5/20/2003 Engrossed DIGEST AND PURPOSE Article 21.52 (Right to Select Practitioner Under Health and Accident Policies) of the Insurance Code prohibits an insurer from discriminating against health care practitioners with regard to payment or reimbursement. H.B. 3023 specifies that certain provisions relating to discrimination against health care practitioners with regard to payment or reimbursement apply only to the rate of payment or reimbursement under a health insurance policy made by an insurance company, association, or organization to which this article applies to the types of practitioners described by this subsection and does not apply to cost-sharing amounts to be paid by a covered person. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3(d), Article 21.52, Insurance Code, to provide that this subsection applies only to the rate of payment or reimbursement under a health insurance policy made by an insurance company, association, or organization to which this article applies to the types of practitioners described by this subsection. Provides that this subsection does not apply to cost-sharing amounts to be paid by a covered person, such as coinsurance, copayments, or deductibles. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective to January 1, 2004.
