SRC-JLB H.B. 3045 78(R) BILL ANALYSIS Senate Research Center H.B. 3045 78R10867 MTB-DBy: Cook, Robby (Shapleigh) Government Organization 5/22/2003 Engrossed DIGEST AND PURPOSE Currently, the Texas Building and Procurement Commission (TBPC) has planning and oversight responsibilities for assigning and allocating space to all agencies under Articles I, II, V, VI, and VIII of the General Appropriations Act. TBPC evaluates and makes a decision on all requests for allocation, relinquishment, or modifications to state leased or owned facilities. However, some believe that the amount of space that agencies have been provided is in excess of the true needs of the agencies and its employees. H.B. 3045 decreases the amount of space that may be allocated to a state agency facility to an average of 135 square feet per agency employee. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2165.104(c), Government Code, to prohibit the Texas Building and Procurement Commission (TBPC), to the extent possible without sacrificing critical public or client services, from allocating usable office space, as defined by TBPC, to a state agency under Article I, II, V, VI, VII, or VIII of the General Appropriations Act or to the Texas Higher Education Coordinating Board, the Texas Education Agency, the State Board for Educator Certification, the Telecommunications Infrastructure Fund Board, or the Office of Court Administration of the Texas Judicial System in an amount that exceeds an average of 135, rather than 153, square feet per agency employee for each agency site. Provides that this subsection does not apply to certain agency sites. SECTION 2. Provides that this Act applies only to a lease for usable office space entered into or renewed on or after September 1, 2003. Requires a lease entered into or renewed before September 1, 2003, to be reviewed by TBPC as the lease comes up for renewal to determine whether it would be cost-effective to bring the lease into compliance with Section 2165.104(c), Government Code, as amended by this Act. SECTION 3. Effective date: September 1, 2003.
