BACKGROUND AND PURPOSE 

In 2001, the Property Code was amended to require commercial landlords to
timely return security deposits.  The bill provided for a 60-day deadline
for return, but the reference to a 30-day deadline was inadvertently not
changed.  This bill cures that inconsistency by changing from a 30-day
deadline to 60 days, as was intended. 



RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency, or
institution. 

ANALYSIS

House Bill 3190 amends the Property Code, as follows:
_specifies to whom the tenant must give notice of the tenant's forwarding
address; and 
_removes the inconsistently between the 60-day deadline in Section 93.005
and the 30-day deadline in Section 93.011. 


EFFECTIVE DATE

September 1, 2003.
