SRC-JEC H.B. 3194 78(R) BILL ANALYSIS Senate Research Center H.B. 3194 78R7459 SLO-DBy: Uresti (Janek) Health & Human Services 5/21/2003 Engrossed DIGEST AND PURPOSE The Texas Department of Protective and Regulatory Services (DPRS) is currently exempt from fees charged for certain documents as required in the Family Code and probate court. However, DPRS is not exempt from fees charged for documents under Sections 118.052 and 118.011 of the Local Government Code. Documents for which fees are charged, such as real estate records and birth and death certificates, are used in Adult Protective Services guardianship and in-home investigation cases. H.B. 3194 adds an exemption for DPRS from these fees. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 40.062, Human Resources Code, to provide that the Department of Protective and Regulatory Services is not required to pay a fee imposed by a county officer under Section 118.011 (Fee Schedule) or 118.052 (Fee Schedule), Local Government Code. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2003.
