SRC-TAG H.B. 3214 78(R) BILL ANALYSIS Senate Research Center H.B. 3214 78R12135 SGA-FBy: Cook, Robby (Armbrister) Natural Resources 5/14/2003 Engrossed DIGEST AND PURPOSE Under current statute, a director of municipal utility district is entitled to receive fees of office of not more than $150 a day for each day the director actually spends performing the duties of directors, not to exceed $6,000 annually, with the exception of directors of certain special water authorities. H.B. 3214 amends the Water Code by increasing the limit on the fees of office that a director of certain general and special law districts may be paid. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 49.060, Water Code, by amending Subsection (a) and adding Subsection (a-1), as follows: (a) Defines "performing the duties of a director." (a-1) Requires a district, by the resolution of the board of the district (board) to limit the fees of office that a director may receive in a year. Prohibits a district from setting the annual limit at an amount greater than $7,200, except for a district that is a special water authority engaged in the distribution and sale of electric energy to the public. Deletes text providing that the fees of office may not exceed $6,000 per annum except for directors of a special water authority. SECTION 2. Repealer: Section 49.060(d) regarding (fees of office; reimbursement), Water Code. SECTION 3. Effective date: upon passage or September 1, 2003.
