SRC-TJG H.B. 3305 78(R) BILL ANALYSIS Senate Research Center H.B. 3305 78R14712 GWK-DBy: Berman (Whitmire) Finance 5/19/2003 Engrossed DIGEST AND PURPOSE H.B. 3305 implements several cost saving measures. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 2102, Government Code, by adding Section 2102.0041, as follows: Sec. 2102.0041. EXEMPTION. Provides that notwithstanding Section 2102.004, this chapter does not apply to the Criminal Justice Policy Council. SECTION 2. Requires the adjutant general's department to reduce expenditures by instituting measures necessary to receive as much federal funding as possible while implementing costsaving measures. SECTION 3. Amends Section 5.50(b), Alcoholic Beverage Code, to delete existing language requiring surcharges to be set at a level so that the anticipated total of all fees collected by the Texas Alcohol and Beverage Commission (TABC) for a fiscal year and all surcharges for a fiscal year are equal to the legislative appropriation to TABC for the regulation of alcoholic beverages. SECTION 4. Amends Section 61.084(f), Human Resources Code, to decrease from 19 to 18 the age at which a person, who is sentenced under a determinate sentence to commitment is to be transferred, to the custody of a certain entity. SECTION 5. Effective date: upon passage or September 1, 2003.
