SRC-TJG C.S.H.B. 3305 78(R)BILL ANALYSIS Senate Research CenterC.S.H.B. 3305 78R17599 GWK-DBy: Berman (Whitmire) Finance 5/23/2003 Committee Report (Substituted) DIGEST AND PURPOSE C.S.H.B. 3305 deletes existing language requiring surcharges to be set at a level so that the anticipated total of all fees collected by the Texas Alcoholic Beverage Commission (TABC) for a fiscal year and all surcharges for a fiscal year are equal to the legislative appropriation to TABC for the regulation of alcoholic beverages. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 5.50(b), Alcoholic Beverage Code, to delete existing language requiring surcharges to be set at a level so that the anticipated total of all fees collected by the Texas Alcoholic Beverage Commission (TABC) for a fiscal year and all surcharges for a fiscal year are equal to the legislative appropriation to TABC for the regulation of alcoholic beverages. SECTION 2. Effective date: upon passage or September 1, 2003.
