SRC-JLB H.B. 3461 78(R) BILL ANALYSIS Senate Research Center H.B. 3461 78R4876 SLO-DBy: Canales (Zaffirini) Jurisprudence 5/22/2003 Engrossed DIGEST AND PURPOSE Currently, the district attorney of the 156th Judicial District, if there is not a county attorney in McMulln County, may perform the duties of the county attorney in said county. However, Live Oak County is paying the costs for its attorney to handle matters in McMullen County. H.B. 3461 deletes the provision authorizing the district attorney to perform the duties of the county attorney in McMullen County. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 43.161, Government Code, as follows: Sec. 43.161. 156TH JUDICIAL DISTRICT. Created from existing Subsection (a). Deletes existing Subsection (b) regarding authorizing the district attorney, if there is no county attorney in McMullen County, to perform the duties of the county attorney in McMullen County. SECTION 2. Effective date: September 1, 2003.
