DIGEST AND PURPOSE 

Section 152.1771 of the Human Resource Code states the Moore County
Juvenile Board shall be composed of seven members:  the county judge of
Moore County, two members appointed by the Moore County Commissioners
Court, two members appointed by the Dumas Independent School District
board of trustees, and two members appointed by the Dumas City Commission.
That section further provides that all costs of expenses and salaries of
the Moore County Juvenile Probation Department may be shared equally among
the three entities. 

The commissioners court presently pays for all salaries and expenses of
the department, yet only has the power to appoint two members to the
board.  H.B. 3584 amends the Human Resources Code to allow the Moore
County Commissioners Court to appoint all six of the appointed members of
the Moore County Juvenile Board. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Sections 152.1771(a), (b), and (e), Human Resources
Code, as follows: 

(a)  Provides that the Moore County Juvenile Board is composed of the
county judge and six persons appointed by the Moore County Commissioners
Court, rather than two persons appointed by the commissioners court, two
persons appointed by the Dumas City Commission, and two persons appointed
by the trustees of the Dumas Independent School District. 

(b)  Provides that the appointed members serve staggered two-year terms
with the terms of three members, rather than one person appointed by the
city, one person appointed by the county, and one person appointed by the
school district, expiring on December 31 of each even-numbered year, and
the terms of three members expiring on December 31 of each odd-numbered
year. 

(e)  Deletes Subsection (e) regarding authorizing certain entities to
agree to pay equally the costs of the salaries and expenses of the
juvenile department. 

SECTION 2.  Requires the two persons appointed by the Moore County
Commissioners Court serving on the Moore County Juvenile Board immediately
before the effective date of this Act to serve the remainder of their
terms.  Requires first four persons appointed on or after the effective
date of this Act to serve on the Moore County Juvenile Board as provided
by Section 152.1771(a), Human Resources Code, as amended by this Act, to
draw lots for staggered terms, so that the terms of three of the six
appointed members expire December 31 of each evennumbered year, and the
terms of the other three of the six appointed members expire December 31
of each odd-numbered year. 
 
SECTION 3.  Effective date:  September 1, 2003.
