H.B. 3584 78(R) BILL ANALYSIS H.B. 3584 By: Swinford Juvenile Justice & Family Issues Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, under Section 152.1771 of the Human Resources Code, the Moore County Juvenile Board shall be composed of six members, two appointed by the Moore County Commissioners Court, two appointed by the Dumas Independent School District board of trustees, and two appointed by the Dumas City Commission with all expenses and salaries shared equally among the three agencies. Moreover, the Moore County Commissioners Court pays for all salaries and expenses of the Board, yet only has the power to appoint two members. House Bill 3584 amends the Human Resources Code to allow the Moore County Commissioners Court to appoint all six members of the Moore County Juvenile Board. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1.Amends Section 152.1771(a),(b), and (e) of the Human Resources Code to allow all six members of the Moore County Juvenile Board to be appointed by the Moore County Commissioners Court. Each member will serve staggered two-year terms, with the terms of three members expiring December 31 of even-numbered years, and the terms of the remaining three expiring December 31 of odd-numbered years. SECTION 2.Designates that the two members appointed by the Moore County Commissioners Court serving immediately before the effective date of this act shall serve the remainder of their term and the additional four members to be appointed, shall draw slots for staggered terms, so that the terms of three members expire December 31 of even-numbered years and the terms of the remaining three expire December 31 of odd-numbered years. SECTION 3.This Act takes effect September 1, 2003. EFFECTIVE DATE September 1, 2003.
