H.B. 3585 78(R) BILL ANALYSIS H.B. 3585 By: Nixon Urban Affairs Committee Report (Unamended) BACKGROUND AND PURPOSE The Westchase Area Management District includes a board of directors whose members are required to hold positions in office, retail, land, and similar categories. Because of changes in the real estate market, at times, the board has trouble finding qualified members to fill board positions. House Bill 3585 would change the qualifications for board members, allowing interested parties to fill positions while keeping an overall representation of the area. The bill would also add telecommunications as a purpose of the District and the power to provide for convention centers. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 376.050, Local Government Code, concerning the appointment of directors, to allow the mayor and members of the governing body to consider for appointment persons representing the named interests, and remove the requirements that certain persons represent specific interests be named to specific positions on the board; in addition the 20,000 or more square feet requirement for the category of owners of multitenant retail property or major retail tenants is removed. SECTION 2. Amends Subchapter B, Chapter 376, Local Government Code, by adding Sections Section 376.066 and 376.067 to allow the district to promote telecommunications services and conference and convocation centers in the district. SECTION 3. Validation clause. SECTION 4. Effective date. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2003.
