C.S.H.C.R. 82 78(R) BILL ANALYSIS C.S.H.C.R. 82 By: Campbell Transportation Committee Report (Substituted) BACKGROUND AND PURPOSE Historically Texas has been a "donor" state when it comes to recovering federal dollars from the fuel tax. Since the highway revenue act of 1956, Texas received an average of 78 cents on the dollar (2001.) Even though currently a minimum rate of 90.5% is being proposed as the new authorized rate, this resolution requests that the U.S. Congress does all it can to set a 95% minimum return rate. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS CSHCR 82 requests the Congress of the United States to provide equity funding to all states by increasing the rate of return from the Highway Trust Fund to 95% of all dollars being distributed to the states. COMPARISON OF ORIGINAL TO SUBSTITUTE HCR 82 requests the Congress of the United States to provide equity funding to all of the states. CSHCR 82 requests the Congress to provide equity funding to Texas by increasing the rate of return of Texas's contribution to the fund to 95 percent.
