SRC-AMY S.B. 6 78(R) BILL ANALYSIS Senate Research Center S.B. 6 78R11989 EMT-FBy: Van de Putte Veteran Affairs & Military Installations 4/22/2003 As Filed DIGEST AND PURPOSE Currently, Texas law provides that a lottery ticket holder forfeits any claim or entitlement to a prize after 180 days after the date on which the winning numbers were selected or after the end of the game, in the case of an instant scratch-off ticket. As proposed, S.B. 6 extends for certain military personnel the period in which a lottery prize may be claimed. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 466.408, Government Code, by amending Subsection (d) and adding Subsections (e)-(h), as follows: (d) Includes a reference to the exemptions set forth in Subsection (e). (e) Authorizes an eligible person serving on active military duty in any branch of the United States armed forces during a war or national emergency declared in accordance with federal law to claim a lottery prize not later than the 90th day after the date on which the earliest of certain situations occurs. (f) Authorizes the Texas Lottery Commission to deduct money paid to an eligible person under Subsection (e) from prize money that would otherwise be deposited under Subsection (b). (g) Defines what is considered active duty. (h) Defines "eligible person." SECTION 2. Effective date: upon passage or September 1, 2003.
