SRC-AMY S.B. 88 78(R) BILL ANALYSIS Senate Research CenterS.B. 88 By: Wentworth Jurisprudence 8/18/2003 Enrolled DIGEST AND PURPOSE Currently, a district attorney may maintain an independent law practice to supplement his or her pay unless that office is listed in the Professional Prosecutors Act, which provides additional state funding to supplement a prosecutor's salary in exchange for prohibiting the prosecutor from the private practice of law. S.B. 88 adds the district attorney for the 25th Judicial District to the list of prosecutors who are subject to the professional prosecutors law. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.002, Government Code, by including the district attorney of the 25th Judicial District in the list of state prosecutors to whom the professional prosecutors law applies. Section 2. Effective date: January 1, 2005.
