SRC-MSY, VRA S.B. 94 78(R) BILL ANALYSIS Senate Research Center S.B. 94 78R794 YDB-FBy: West Infrastructure Development and Security 2/13/2003 As Filed DIGEST AND PURPOSE Currently, a Texas driver who has been cited with a DWI and had his or her license suspended can be issued a temporary driving permit immediately. Texas law currently specifies that a temporary driving permit issued to the driver of a commercial vehicle cited for DWI does not take effect for 24 hours. As proposed, S.B. 94 amends the Transportation Code to delay the issuance of a driving permit to any driver cited for DWI by 24 hours in order to increase the chances that the driver is no longer intoxicated when he or she legally drives again. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 524.011(f), Transportation Code, to provide that a temporary driving permit issued under this section expires on the 41st day after the date of issuance and is not effective until 24 hours after the time of arrest. Deletes text applying to commercial vehicles. SECTION 2. Amends Section 724.032(e), Transportation Code, to make conforming changes. SECTION 3. Makes application of this Act prospective. SECTION 4. Effective date: September 1, 2003.
