DIGEST AND PURPOSE 


Within the last decade, abuse and misuse of certain prescription drugs,
especially pain medications,  has become prevalent.  Studies have
indicated that educating the appropriate health care providers about the
growing problem and providing them with information will create a
heightened awareness of the appropriate use of pain medication as well as
the misuse and diversion of addictive pain medication.  S.B. 144 requires
the governing boards of several health professions to provide their
members with information about prescribing pain medications and addiction.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter A, Chapter 153, Occupations Code, by adding
Sections 153.014 and 153.015, as follows: 

Sec.  153.014.  INFORMATION PROVIDED TO LICENSE HOLDERS.  Requires the
Texas State Board of Medical Examiners (TSBME), at least once each
biennium, to provide to license holders certain information regarding the
use and abuse of certain drugs. 

Sec.  153.015.  POISON CONTROL CENTER INFORMATION.  Requires TSBME to
provide to license holders information regarding the services provided by
poison control centers. 

SECTION 2.  Amends Subchapter D, Chapter 202, Occupations Code, by adding
Sections 202.160 and 202.161, as follows: 

Sec. 202.160  INFORMATION PROVIDED TO LICENSE HOLDERS.  Requires the Texas
State Board of Podiatric Medical Examiners (TBPME), at least once each
biennium, to provide to license holders certain information regarding the
use and abuse of certain drugs. 
 
Sec. 202.161.  POISON CONTROL CENTER INFORMATION.  Requires TBPME to
provide to license holders information regarding the services provided by
poison control centers. 

SECTION 3.  Amends Chapter 254, Occupations Code, by adding Sections
254.013 and 254.014, as follows: 

Sec. 254.013.  INFORMATION PROVIDED TO LICENSE HOLDERS.  Requires the
State Board of Dental Examiners (SBDE), at least once each biennium, to
provide to license holders certain information regarding the use and abuse
of certain drugs. 
 
 Sec. 254.014.  POISON CONTROL CENTER INFORMATION.  Requires SBDE to
provide to license holders information regarding the services provided by
poison control centers. 

SECTION 4.  Amends Subchapter D, Chapter 301, Occupations Code, by adding
Sections 301.1581 and 301.1582, as follows: 

Sec. 301.1581.  INFORMATION PROVIDED TO LICENSE HOLDERS.  Requires the
Board of Nurse Examiners (BNE), at least once each biennium, to provide to
license holders certain information regarding the use and abuse of certain
drugs. 
 
Sec.  301.1582.  POISON CONTROL CENTER INFORMATION.  Requires BNE to
provide to license holders information regarding the services provided by
poison control centers. 

SECTION 5.  Amends Subchapter D, Chapter 302, Occupations Code, by adding
Sections 302.1551 and 302.1552, as follows: 

Sec. 302.1551.  INFORMATION PROVIDED TO LICENSE HOLDERS.  Requires the
Board of Vocational Nurse Examiners (BVNE), at least once each biennium,
to provide to license holders certain information regarding the use and
abuse of certain drugs. 
 
Sec. 302.1552.  POISON CONTROL CENTER INFORMATION.  Requires BVNE to
provide to each license holder information regarding the services provided
by poison control centers. 

SECTION 6.  Amends Subchapter D, Chapter 351, Occupations Code, by adding
Sections 351.166 and 351.167, as follows: 

Sec. 351.166.  INFORMATION PROVIDED TO LICENSE HOLDERS.  Requires BVNE, at
least once each biennium, to provide certain information to license
holders.  

Sec. 351.167.  POISON CONTROL CENTER INFORMATION.  Requires BVNE to
provide to license holders information regarding the services provided by
poison control centers. 

SECTION 7.  Amends Subchapter A, Chapter 554, Occupations Code, by adding
Sections 554.014 and 554.015, as follows: 

Sec. 554.014.   INFORMATION PROVIDED TO LICENSE HOLDERS.  Requires the
Texas State Board of Pharmacy (TSBP), at least once each biennium, to
provide to license holders certain information regarding the use and abuse
of certain drugs. 
 
Sec. 554.015.  POISON CONTROL CENTER INFORMATION.  Requires TSBP to
provide to license holders information regarding the services provided by
poison control centers. 

SECTION 8.  Effective date:  September 1, 2003.

(b)  Requires a state agency that is subject to this Act to develop
materials that contain the information required by this Act not later than
January 1, 2004.  Authorizes the materials described by this section to be
provided by electronic or other means.  Requires the state agencies that
are subject to this Act to cooperate in developing the materials and to
ensure, to the extent possible, that the same information is contained in
the materials used by each agency.
