DIGEST AND PURPOSE 

Currently, Section  341.011(7), Texas Health and Safety Code, deems "a
collection of water in which mosquitoes are breeding in the limits of a
municipality"  to be a public health nuisance. Unincorporated areas are
not included in that definition.  In Harris County, over 1.3 million
people live outside any city limit.  S.B. 185 amends Section 341.011(7) to
limit its coverage to areas that serve as breeding sites for Culex
quinquefasciatus mosquitoes that can transmit diseases regardless of the
water collection's location. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 341.011, Health and Safety Code, by adding that
a collection of water in which mosquitoes are breeding in the limits of a
municipality or a collection  of water that is a breeding area for Culex
quinquefasciatus mosquitoes that can transmit diseases regardless of the
collection's location, other than a location or property where activities
meeting the definition of Section 11.002(12) (A), Water Code, occur, is a
public health nuisance. 

SECTION 2.  Effective date:  upon passage or September 1, 2003.
