SRC-LBB, JLB S.B. 185 78(R) BILL ANALYSIS Senate Research Center S.B. 185 78R1745 JTS-FBy: Janek Health & Human Services 3/28/2003 As Filed DIGEST AND PURPOSE Currently, Section 341.011(7), Texas Health and Safety Code, deems "a collection of water in which mosquitoes are breeding in the limits of a municipality" to be a public health nuisance. Unincorporated areas are not included in that definition. In Harris County, over 1.3 million people live outside any city limit. As proposed, S.B. 185 amends Section 341.011(7) to limit its coverage to areas that serve as breeding sites for mosquitos that can transmit diseases regardless of the water collection's location. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 341.011, Health and Safety Code, by adding that a collection of water in which mosquitoes are breeding in the limits of a municipality or that is a breeding area for mosquitoes that can transmit diseases regardless of the collection's location is a public health nuisance. SECTION 2. Effective date: September 1, 2003.
