DIGEST AND PURPOSE 

Currently, many states participate in multi-state lottery games in order
to increase lottery revenues. Texas does not participate in a multi-state
lottery.  As proposed, S.B. 217 would require the Texas Lottery Commission
to participate in multi-state lottery games. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 466, Government Code, by adding Subchapter J,
as follows: 

SUBCHAPTER J.  PARTICIPATION IN MULTISTATE LOTTERY GAMES

Sec.  466.451.  MULTISTATE AGREEMENT AUTHORIZED.  Requires the Texas
Lottery Commission (lottery) to enter into a written agreement with the
appropriate officials of one or more other states or take other
appropriate action to participate in the operation of one or more ongoing
multistate lottery games. 

Sec.  466.452.  REVENUE FROM MULTISTATE LOTTERY.  (a)  Provides that
except as provided by this section, revenue received from the sale of
tickets in this state for a multistate lottery game is subject to
Subchapter H (Revenue). 

(b)  Authorizes the lottery to deposit a portion of the revenue received
from the sale of multistate lottery game tickets in this state into a fund
shared with other parties to an agreement under this subchapter for the
payment of prizes awarded in multistate lottery games in which the lottery
participates and to retain the portion of revenue deposited in the fund
for as long as necessary to pay prizes claimed during the period
designated for claiming a prize in a multistate lottery game. 

Sec.  466.453.  PAYMENT OF COSTS AUTHORIZED.  Authorizes the lottery to
share in the payment of costs associated with participating in multistate
lottery games. 
       
SECTION 2.  Effective date:  upon passage or September 1, 2003.
