SRC-JLB S.B. 271 78(R)BILL ANALYSIS Senate Research CenterS.B. 271 By: Jackson Government Organization 8/14/2003 Enrolled DIGEST AND PURPOSE The 71st Texas Legislature created the Riding Stables Chapter (chapter) in the Occupations Code in 1989 to promote humane treatment of and conditions for horses used in recreational riding and carriage stables. However, the Sunset Advisory Commission staff finds that no significant problems have been uncovered or addressed through 13 years of inspections and investigations of complaints. S.B. 271 repeals the Riding Stables Chapter, ending state regulation of riding stables in Texas. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Chapter 2053 (Riding Stables), Occupations Code. SECTION 2. (a) Provides that any administrative, civil, or criminal proceeding under Chapter 2053, Occupations Code, that is pending before the Texas Animal Health Commission or a court on September 1, 2003, is dismissed on that date. (b) Provides that any unexpended and unobligated appropriations for the administration of Chapter 2053, Occupations Code, lapse on September 1, 2003. SECTION 3. Effective date: September 1, 2003.
