SRC-TJG S.B. 307 78(R) BILL ANALYSIS Senate Research Center S.B. 307 78R146 SMH-DBy: Gallegos Criminal Justice 3/7/2003 As Filed DIGEST AND PURPOSE Currently, the Texas Commission on Law Enforcement Officer Standards and Education consists of nine members, who are appointed by the governor and subject to confirmation by the senate. Three of the members of the board are required to be either a sheriff, constable, or chief of police. As proposed, S.B. 307 ensures equal representation on the board by providing that there be one of each: a sheriff, constable, and chief of police. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 1701.051(a), Occupations Code, to provide that the Commission on Law Enforcement Officer Standards and Education (commission) consists of nine members, including one member who is a sheriff, one who is a constable, and one who is a chief of police. Deletes existing text relating to the composition of the commission. Redesignates Subsections 2 and 3 as 4 and 5. SECTION 2. Amends Section 1701.054(a), Occupations Code, to make conforming changes relating to the composition of the commission. SECTION 3. (a) Makes application of this Act prospective. (b) Requires the governor, as soon as possible on or after the effective date of this Act, as the terms of members of the commission expire or as vacancies occur, to appoint members to the commission so that the commission is composed in accordance with Section 1701.051(a), Occupations Code, as amended by this Act. SECTION 4. Effective date: upon passage or September 1, 2003.
