S.B. 322 78(R) BILL ANALYSIS S.B. 322 By: Armbrister Judicial Affairs Committee Report (Unamended) BACKGROUND AND PURPOSE Under current law, retired municipal judges are not authorized to administer oaths in Texas. S.B. 322 adds retired municipal judges to the list of individuals authorized to administer an oath and give a certificate indicating that an oath has been given. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS S.B. 322 amends the Government Code to provide that an oath made in this state may be administered and a certificate of the fact given by a retired judge of a municipal court. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect on September 1, 2003.
