SRC-LBB, VRA S.B. 330 78(R)BILL ANALYSIS Senate Research CenterS.B. 330 By: Nelson Health & Human Services 8/11/2003 Enrolled DIGEST AND PURPOSE Currently, under the provisions of S.B. 11, 77th Legislature, state law is more restrictive than federal law regarding the conduct of medical research in Texas. S.B. 11 included provisions of the federal Health Insurance Portability and Accountability Act (HIPAA) regulation at the time of its passage. The Bush Administration altered the HIPAA regulation on March 27, 2002, and consequently state law became more restrictive than the federal law. S.B. 330 repeals two provisions of state law in order to bring Texas law into concert with federal law. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Sections 181.101 (Compliance With Federal Regulations) and 181.102 (Information for Research), Health and Safety Code. SECTION 2. Effective date: September 1, 2003.
