DIGEST AND PURPOSE 

Currently, certain cities located in two counties are not authorized to
hold a local option election for consumption of alcoholic beverages.  As
proposed, S.B. 359 would allow for a local option election in cities
located in more than one county where a portion of that city did not
permit beer and wine sales. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 251.18(a), Alcoholic Beverage Code, to provide
that this section applies only to an election to permit or prohibit the
legal sale of beer and wine in an incorporated city or town that does not
permit beer and wine sales in all or a portion of the city or town on
September 1, 2003, and is located in two counties that each have a
population of at least 400,000 but not more than one million.   

SECTION 2.  Effective date:  September 1, 2003.
