SRC-TJG, JLB S.B. 367 78(R) BILL ANALYSIS Senate Research Center S.B. 367 78R3193 QS-FBy: Lindsay Natural Resources 3/4/2003 As Filed DIGEST AND PURPOSE Currently, Kuykendahl Road Public Utility District No. 1 (district) is inactive and is no longer owned by the landowners originally benefitted by the creation of the district. All of the property is now owned by the Woodlands Land Development Company, L.P. Overlapping or adjacent municipal utility districts have been recently created to serve all of the functions and purposes of the district. The district has no assets, liabilities, or obligations and has issued no bonds. As proposed, S.B. 367 dissolves and abolishes the district without the delays and expenses associated with filing and prosecuting dissolution proceedings with the Texas Commission on Environmental Quality under Chapter 49, Texas Water Code. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. DISSOLUTION. (a) Provides that the Kuykendahl Road Public Utility District No. 1 is dissolved. (b) Repealer: Chapter 678, V.T.C.S. (Kuykendahl Road Public Utility District No. 1). SECTION 2. FINDINGS RELATED TO DISSOLUTION. Provides that the legislature finds that the Kuykendahl Road Public Utility District No. 1 meets certain conditions relating to its dissolution. SECTION 3. EFFECTIVE DATE. Effective date: upon passage or September 1, 2003.
