S.B. 368 78(R) BILL ANALYSIS S.B. 368 By: Lindsay Natural Resources Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, Kuykendahl Road Public Utility District No. 2 (district) is not activated and is no longer owned by the landowners originally benefitted by the creation of the district. All of the property is now owned by the Woodlands Land Development Company, L.P. Overlapping or adjacent municipal utility districts have been recently created to serve all of the functions and purposes of the district. The district has no assets, liabilities, or obligations and has issued no bonds. As proposed, S.B. 368 dissolves and abolishes the district without the delays and expenses associated with filing prosecuting dissolution proceedings with the Texas Commission on Environmental Quality under Chapter 49, Texas Water Code. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. DISSOLUTION. (a) Provides that the Kuykendahl Road Public Utility District No. 2 is dissolved. (b) Repealer: Chapter 677, Acts of the 62nd Legislature, Regular Session, 1971 (Kuykendahl Road Public Utility District No. 2 ). SECTION 2. FINDINGS RELATED TO DISSOLUTION. Provides that the legislature finds that the Kuykendahl Road Public Utility District No. 2 meets certain conditions relating to its dissolution. SECTION 3. EFFECTIVE DATE. Effective date: upon passage or September 1, 2003. EFFECTIVE DATE The Act takes effect upon passage, or if the Act does not receive the necessary vote, the Act takes effect on September 1, 2003.
