S.B. 370 78(R) BILL ANALYSIS S.B. 370 By: Lindsay Natural Resources Committee Report (Unamended) BACKGROUND AND PURPOSE Under Section 14(b), Chapter 1381, Acts of the 77th legislature, Regular Session, 2001, providing for the creation of Harris County Municipal Utility District No. 386, the creation of the district must be confirmed before September 1, 2003. However, the creation and confirmation of the district prior to the expiration of this legislation is uncertain. As proposed, S.B. 370 extends the date for expiration of the legislation and the period in which a confirmation election may be held to September 1, 2006. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Amends Section 14(b), Chapter 1381, Acts of the 77th Legislature, Regular Session, 2001, to provide that if the creation of the district is not confirmed at a confirmation election held under Section 10 of this Act before September 1, 2006, rather than September 1, 2003, this Act expires on that date. SECTION 2. Effective date: upon passage or September 1, 2003. EFFECTIVE DATE The Act takes effect upon passage, or if the Act does not receive the necessary vote, the Act takes effect on September 1, 2003.
