S.B. 372 78(R) BILL ANALYSIS S.B. 372 By: Lindsay Natural Resources Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, Section 14(b), Chapter 1383, Acts of the 77th Legislature, Regular Session, 2001, provides for the creation of Harris County Municipal Utility District No. 388 and requires that the creation of the district be confirmed before September 1, 2003; otherwise, the legislation expires on said date. However, development has been delayed by regulatory and planning constraints, and it may not be possible to call and conduct a confirmation election within the district prior to September 1, 2003. As proposed, S.B. 372 extends the date for expiration of the legislation and the conduct of a confirmation election until September 1, 2006, to afford sufficient time for commencing development, and calling for and conducting such election. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Amends Section 14(b), Chapter 1383, Acts of the 77th Legislature, Regular Session, 2001, to provide that if the creation of the Harris County Municipal Utility District No. 388 is not confirmed at a confirmation election held under Section 10 of this Act before September 1, 2006, rather than 2003, this Act expires on that date. SECTION 2. Effective date: upon passage or September 1, 2003. EFFECTIVE DATE The Act takes effect upon passage, or if the Act does not receive the necessary vote, the Act takes effect on September 1, 2003.
