DIGEST AND PURPOSE 

Currently, Texas law does not allow magistrates or retired magistrates to
conduct a marriage ceremony. As proposed, S.B. 379 would allow a
magistrate or a retired magistrate to perform a marriage ceremony. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 2.202(a), Family Code, to add a magistrate or
retired magistrate to the list of officials who are authorized to conduct
a marriage ceremony. 

SECTION 2.  (a)  Effective date:  September 1, 2003.
           (b)  Makes application of this Act prospective.
