SRC-VRA S.B. 391 78(R) BILL ANALYSIS Senate Research Center S.B. 391 78R3389 MI-DBy: Harris Intergovernmental Relations 2/17/2003 As Filed DIGEST AND PURPOSE Currently, a county sheriff has exclusive control of the county jail commissary funds and may make contracts. State law does provide exceptions to these provisions which applies to a county with a population of one million or more and which contains two municipalities with a population of 300,000 or more. As proposed, S.B. 391 decreases the size of the population to which this exception applies from 300,000 to 200,000. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 351.04155(a), Local Government Code, to provide that this section applies only to a county with a population of one million or more and which has two municipalities with a population of 200,000 or more rather than 300,000 or more, regarding the operation of a jail commissary by a sheriff in certain counties. SECTION 2. Effective date: September 1, 2003.
