SRC-JLB S.B. 411 78(R) BILL ANALYSIS Senate Research Center S.B. 411 78R3211 YDB-DBy: Zaffirini Intergovernmental Relations 2/20/2003 As Filed DIGEST AND PURPOSE Currently, provisions in the Local Government Code include a minimum population requirement, which Zapata County does not meet, for an increase in salaries for sheriff's department employees. As proposed, S.B. 411 removes the population requirements regarding salary and longevity pay to allow any county government to provide for longevity pay for sheriff's department employees, allows voters to petition the county commissioners court to increase the minimum salary of employees of the sheriff's department, and requires the county government to classify all sheriff's department positions and salaries. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 152.071(a), Local Government Code, by deleting the population bracket to require a county government, regardless of population, to classify all positions in its sheriff's department and to specify the duties and prescribe the salary for each classification. SECTION 2. Amends Section 152.072(a), Local Government Code, by deleting the population bracket to authorize the qualified voters of a county, regardless of population, to petition the commissioners court of the county to increase the minimum salary of each member of the sheriff's department. SECTION 3. Amends Section 152.074(a), Local Government Code, by deleting the population bracket to require the commissioners court of a county, regardless of population, to provide longevity pay for each commissioned deputy of the sheriff's department of not less than $5 a month for each year of service in the department, up to and including 25 years. SECTION 4. Effective date: September 1, 2003.
