DIGEST AND PURPOSE 

Currently, the Comal County Juvenile Board (board) is composed of the
county judge, the judge of the Comal County Court at Law, and the judge of
the 207th District Court.  S.B. 469 adds an additional district judge and
the criminal district attorney of Comal County to the board, but the
criminal district attorney would only vote to break a tie vote of the
other members.  This bill also provides for the local administrative
statutory county judge to be a member of the board. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 152.0521, Human Resources Code, by amending
Subsection (a) and adding Subsection (a-1), as follows: 

(a) Provides that the Comal County Juvenile Board (board) is composed of
the county judge, the local administrative statutory county judge, the
judge of the 207th District Court, an additional judge of the district
courts having jurisdiction in Comal County, to be appointed biennially by
the local administrative district judge, and the criminal district
attorney of Comal County.   

(a-1) Prohibits the criminal district attorney of Comal County from voting
except to break a tie vote of the other members of the board. 

SECTION 2.  Requires the presiding judge of the district courts having
jurisdiction in Comal County, not later than October 1, 2003, to appoint a
district court judge to the Comal County Juvenile Board as required by
Section 152.0521(a), Human Resources Code, as amended by this Act. 

SECTION 3.  Effective date:  upon passage or September 1, 2003.
