DIGEST AND PURPOSE 

Currently, Texas law designates certain highways from which an off-premise
sign may not be visible.  As proposed, S.B. 470 designates a portion of
the Spring-Cypress Road in Harris County between State Highway 249 and
Interstate Highway 45 as a scenic route and prohibits the erecting of an
off-premise sign adjacent to and visible from that road. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 251A, Transportation Code, by adding Section
251.0135, as follows: 

Sec. 251.0135.  SPECIAL DESIGNATION OF ROADS.  Provides that
Spring-Cypress Road in Harris County between State Highway 249 and
Interstate Highway 45 is a scenic route. Requires the Harris County
Commissioners Court to design and construct markers indicating the road as
a scenic route and place them at either end and along the route as the
commissioners court deems appropriate. 

SECTION 2.  Amends Section 391.252(a), Transportation Code, to prohibit a
person from erecting an off-premise sign adjacent to and visible from
Spring-Cypress Road between State Highway 249 and Interstate Highway 45.
Makes nonsubstantive changes. 

SECTION 3.  Effective date: upon passage or September 1, 2003.
