SRC-TAG S.B. 476 78(R) BILL ANALYSIS Senate Research Center S.B. 476 78R1160 JRJ-DBy: Barrientos Education 4/2/2003 As Filed DIGEST AND PURPOSE Currently, it is illegal for a person to engage in, aid, or recklessly permit "hazing" at a public or private high school or a public post-secondary educational institution. As proposed, S.B. 476 expands the prohibition against hazing to include private post-secondary educational institutions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 51.936, Education Code, by amending Subsections (a) and (b) and adding Subsection (e), as follows: (a) Provides that Chapter 37F applies to a postsecondary educational institutions, rather than to hazing at an educational institution, under this section in the same manner as that subchapter applies to a public or private high school. (b) Defines "postsecondary educational institution." (c) Provides that Section 1.001(a) does not limit the application of this section to postsecondary educational institutions supported in whole or part by state tax funds. SECTION 2. Effective date: September 1, 2003.
