SRC-LBB S.B. 478 78(R)BILL ANALYSIS Senate Research CenterS.B. 478 By: Duncan State Affairs 6/18/2003 Enrolled DIGEST AND PURPOSE Currently, the law is unclear in regards to workers' compensation benefits relating to certain persons who perform services that benefit a political subdivision. S.B. 478 clarifies that a person who performs services that may benefit a political subdivision in connection with the operation of certain entertainment events, but who does not receive payment from the political subdivision for the performance of those services, is not eligible for workers' compensation benefits from the political subdivision. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 504.014, Labor Code, to provide that a person is not an employee and is not entitled to workers compensation benefits under this chapter if the person falls under certain entertainment categories. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective.
