S.B. 520 78(R) BILL ANALYSIS

S.B. 520
By: Duncan
Judicial Affairs
Committee Report (Unamended)

BACKGROUND AND PURPOSE

Currently, Upton County is in both the 83rd and the 112th Judicial
Districts. The county commissioners do not believe that either the
population or the docket size of the county warrants the county's
inclusion in two districts. Accordingly, S.B. 520 removes Upton County
from the 83rd Judicial District.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency, or
institution.

ANALYSIS

S.B. 520 amends the Government Code to remove Upton County from the 83rd
Judicial District, makes provision for the transfer of cases pending from
Upton County from the 83rd to the 112th Judicial District as well as the
administration of those cases, and removes Upton County from the list of
counties whose voters elect a district attorney for the 83rd district.

EFFECTIVE DATE

September 1, 2003.
