SRC-TJG S.B. 564 78(R) BILL ANALYSIS Senate Research Center S.B. 564 78R3251 SMJ-DBy: West Health & Human Services 3/4/2003 As Filed DIGEST AND PURPOSE Current law permits school districts to contract with treatment programs to provide treatment services at alternative schools but does not allow school districts to do so at regular school locations. School districts are permitted to contract with other entities to provide similar services in regular school settings. As proposed, S.B. 564 adds treatment facilities funded by the Texas Commission on Alcohol and Drug Abuse to the list of exempted entities with which school districts may contract for outpatient services. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 164.004, Health and Safety Code, to add facilities funded by the Texas Commission on Alcohol and Drug Abuse to the list of exempted facilities, relating to the application of certain marketing and contracting restrictions to treatment facilities. SECTION 2. Effective date: upon passage or September 1, 2003.
