DIGEST AND PURPOSE

Currently, Texas law prohibits removing an evicted tenant's property from
a rental unit in rain, sleet, or snow. This is necessary to protect a
tenant's personal property from the elements, but can cause scheduling
problems. As proposed, S.B. 580 specifies that an officer may remove a
tenant's personal property from the rental unit during inclement weather
if the services of a bonded or insured warehouseman are used to transport
and store the property.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency.
