SRC-AMY S.B. 580 78(R) BILL ANALYSIS Senate Research Center S.B. 580 78R5564 KCR-DBy: Jackson Business & Commerce 3/21/2003 As Filed DIGEST AND PURPOSE Currently, Texas law prohibits removing an evicted tenant's property from a rental unit in rain, sleet, or snow. This is necessary to protect a tenant's personal property from the elements, but can cause scheduling problems. As proposed, S.B. 580 specifies that an officer may remove a tenant's personal property from the rental unit during inclement weather if the services of a bonded or insured warehouseman are used to transport and store the property. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 24.0061(d) and (e), Property Code, as follows: (d) Makes a conforming change in accordance with Subsection (e). (e) Authorizes a police officer to remove a tenant's personal property from a rental unit during inclement weather if the officer chooses to use the services of a bonded or insured warehouseman. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective.
